The Fresh Grocer supermarket at 40th and Walnut, which has operated in that location since 2001, has closed its doors. It was reported last month that the store management had agreed to free the space this month after a four-year legal battle with the landlord – the University of Pennsylvania, which ended the Fresh Grocer’s lease in 2016.
Penn has signed a lease for 40th and Walnut with Acme Markets. The new supermarket is not expected to open until Fall 2020, according to a report by The Daily Pennsylvanian. The space will undergo renovations in preparation for Acme’s opening.

UPDATE: Fresh Grocer will be closing the store at 40th and Walnut Streets in early March, according to Jennifer Rizzi, Director of Communications at the University of Pennsylvania. Penn has signed a lease with Acme Markets for this location. Acme is currently working on an anticipated timeframe for renovations to the existing facility and anticipated opening.
Fresh Grocer will leave its 40th and Walnut Street location this spring after four years of legal battle with the landlord – The University of Pennsylvania. According to a joint statement from Penn and Fresh Grocer, the store will close in March 2020, after almost 20 years in operation.
Penn terminated the Fresh Grocer’s lease in April 2016, claiming that the store had failed to renew it on time. Fresh Grocer countered with a lawsuit against Penn and refused to vacate the space until this spring. Continue Reading

Workers at the Fresh Grocer at 40th and Walnut were erecting a new sunscreen display near the checkout lines this morning, getting the store ready for the spring. Nothing strange about that, except that the store was supposed to close today for good to make way for a new supermarket operator.
Fresh Grocer’s property lease expires today, March 31, according to the University of Pennsylvania’s Facilities and Real Estate Services office. The office manages Penn’s vast holdings in West Philadelphia and has plans for the space that do not include Fresh Grocer.
“Penn has notified Fresh Grocer that its lease will expire on March 31 and that it must vacate the store by that date,” spokeswoman Jennifer Rizzi wrote in an e-mail on March 30. “However, Fresh Grocer rejects Penn’s position that the lease expires on that date, so we do not know whether they will vacate the store on March 31.” Continue Reading

The University of Pennsylvania has confirmed that the Fresh Grocer that has been operating at the corner of 40th and Walnut for 15 years will soon be replaced by another operator.
In an e-mail to West Philly Local, Jennifer Rizzi, Director of Communications at Penn, confirmed that the university, which owns the building where the Fresh Grocer is currently located, “began lease discussions with a new operator and will soon announce plans with this operator for an exciting, upgraded state of the art urban supermarket at the 40th and Walnut location.” The decision to seek proposals from a variety of grocery stores for this location was made after the Fresh Grocer “failed to renew the lease for almost 4 months after the deadline [November 2015],” according to the email. Come April 2017, Acme may replace Fresh Grocer at 40th and Walnut. Fresh Grocer, which is affiliated with ShopRite, “did not renew their lease in a timely fashion,” according to a statement released on Monday by the University of Pennsylvania. The statement also said that Penn identified a new operator for this location, which is reportedly Acme.
Fresh Grocer employees and customers have been distributing flyers asking passersby to support Fresh Grocer.
Signed by The Burns Family (Patrick J. Burns is Fresh Grocer’s president and CEO), the flyer urges customers to contact Penn’s executive vice president Craig Carnaroli by phone and email, join the movement to save the store on Facebook, and use a #SavePennFroGro hashtag on social media.
The Philadelphia Inquirer‘s staff writer Jason Nark spoke to Fresh Grocer customers and asked their opinion about the store’s possible closing. Read his report here.
